Terms of Service

1. Acceptance of Terms

By accessing or using the HF Health AI platform at hfhealth.care (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you and HF Health AI, a product of Helios Frontier. If you do not agree to these Terms, you must not use the Service.

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. Users under 18 must have parental or guardian awareness of their use of the Service. By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate accounts of users who misrepresent their age.

The Service is not available to users who have been previously banned from the platform or whose accounts have been terminated for violations of these Terms.

3. Nature of the Service — Educational Information Only

HF Health AI provides AI-generated health education content through specialized AI educators. The Service is designed to help you understand health topics, prepare questions for your doctor, and learn about medical conditions in general terms.

The Service does NOT:

• Provide medical advice, diagnosis, or treatment recommendations for your specific situation
• Establish a doctor-patient relationship between you and any person or AI system
• Replace consultation with a licensed physician, nurse practitioner, or other qualified healthcare provider
• Constitute emergency medical services

You acknowledge that AI-generated content may occasionally be inaccurate, incomplete, or out of date. You should never disregard professional medical advice or delay seeking it because of something you read on this platform.

4. User Accounts

To access certain features, you must create an account with a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately at [email protected] of any unauthorized use of your account
• Providing accurate, current, and complete information during registration

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or engage in abusive behavior.

5. Subscriptions and Payments

Certain features of the Service require a paid subscription or the purchase of question credits. By selecting a subscription plan or purchasing credits, you agree to pay the applicable fees as described on our Pricing page.

• Recurring subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date via your My Plan page.
• Refunds: Subscription fees are generally non-refundable. If you believe you were charged in error, contact us at [email protected] within 7 days of the charge.
• Payment processing is handled by PayPal. We do not store your payment credentials. PayPal's terms and privacy policy govern payment transactions.
• Credit packs are non-refundable and expire if your account is deleted.
• We reserve the right to change pricing with 30 days' advance notice to existing subscribers.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Attempt to circumvent usage limits, free trial restrictions, or age verification
• Transmit any content that is harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Scrape, crawl, or systematically extract data from the Service without our written permission
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Use the Service to generate, distribute, or promote misinformation about health topics
• Engage in any activity that interferes with or disrupts the Service

7. Crisis Safety Protocol

Our AI specialists are programmed to detect signs of self-harm, suicidal ideation, or acute distress. When such signals are detected, the AI will pause educational content and provide immediate contact information for national crisis resources, including the 988 Suicide & Crisis Lifeline and Crisis Text Line. This is a safety feature, not a substitute for professional crisis intervention.

If you or someone you know is in immediate danger, call 911 or go to your nearest emergency room.

8. Intellectual Property

The Service, including all content, features, and functionality (including but not limited to text, graphics, logos, AI specialist personas, and software), is owned by Helios Frontier and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the Service without our express written permission.

Our source code is maintained in a public GitHub repository as part of our commitment to transparency. Viewing the code is permitted under the applicable open-source license terms. Commercial use, redistribution, or creation of competing services from our codebase requires explicit written permission from Helios Frontier.

9. User-Generated Content

By submitting content to the Service (including chat messages and symptom descriptions), you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service. You retain ownership of your content.

You represent that you have the right to submit any content you provide and that doing so does not violate any third-party rights. We reserve the right to remove any content that violates these Terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We make no warranty regarding the accuracy, completeness, or reliability of any health information provided through the Service. The Service is not a substitute for professional medical judgment.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HELIOS FRONTIER AND HF HEALTH AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless Helios Frontier, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

You may delete your account at any time from your My Plan page. Account deletion is permanent and irreversible.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules.
